- Information on how to enter forms part of the Terms and Conditions. By entering the promotion, entrants accept these Terms and Conditions.
- The entrant must purchase an Aqua Technics swimming pool from Aqua Technics Joondalup, O’Connor or Mandurah and have signed a contract for a swimming pool between Friday 1st November 2024 and Tuesday 31st December 2024. The full deposit up to 6.5% as specified in the SPASA Swimming Pool Contract must be paid for entry to be valid.
- Competition is valid for Perth metro installations only.
- Upon signing of the swimming pool contract, the pool buyer will be entered into the draw. All signed contracts must be received by head office by Friday 10th January 2025. Conditional contracts will not be eligible to enter if they are still conditional status at the close of the competition dates.
- The winner will be decided by a random draw on Friday 31st January 2025 and notified by Wednesday 5th February 2025. The first official entry drawn will be deemed the winner. The judge’s decision is final and cannot be contested. No correspondence will be entered into.
- The successful winner will be paid the $10,000 cashback by Direct Deposit once the swimming pool has been installed and all contractual payments as per the SPASA Swimming Pool Contract have been made.
- If the winner has a contract for a House Under Construction, the pool completion and handover must be completed and fully paid for within 2 years of the competition draw date to receive the cashback prize.
- To be a valid entrant, the entrant must:
- Be a permanent resident of Australia, currently residing in Western Australia
- Be the legal property owner of the residence in which the pool will be installed
- Be 18 years of age or over
AND must not be:
- A director, officer or employee of Aqua Technics or any agency and company associated with the promotion; or
- An immediate family member of a director, officer or employee of the Promoter or any agency and company associated with the promotion.
- SPASA swimming pool contract conditions apply. In the event of the contract being cancelled, the entry will no longer be valid.
- No responsibility will be accepted for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever.
- All entries are deemed to be received at the time of receipt by the Promoter
- The Promoter reserves the right, at any time during or after the closing date of the promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- If a winner is disqualified in accordance with these Terms and Conditions, the Promoter reserves the right to award the prize to the next valid entry drawn. The same principle will apply to any further disqualifications.
- The Promoter’s decisions are final and no correspondence will be entered into. The prize cannot be exchanged and can only be transferred at the absolute discretion of the Promoter.
- The Promoter, its directors, officers, employees, agents and any related agency or company associated with this promotion will not be, under any circumstances whatsoever, whether by reason of breach of contractor statutory duty, negligence or other tort, indemnity, breach of warranty or otherwise, be liable for any loss (including but not limited to any indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person’s negligence) relating to this promotion or the awarding or taking of any prize, except for any liability which cannot be excluded by law. By entering this promotion, entrants accept and acknowledge full responsibility for their decision to participate in the promotion and in taking of the prize.
- The Promoter will make all reasonable efforts to contact the winner. If the Promoter has not been able to contact the winner within one (1) month of the determination date, or for any reason the prize remains unclaimed for one (1) month after the determination date, the relevant winner’s entry will be deemed invalid and the Promoter will award the prize to the next valid entry drawn.
- It is a condition of accepting the prize that the winner agrees to participate in promotional activities and be photographed at any time during the acceptance of the prize by the Promoter or its agents. There is no obligation upon the Promoter to use such images but if the Promoter elects to do so, the winner consents to them using their name, likeness and image in any media for the purpose of promoting this competition, including any outcome, for an unlimited period of time without remuneration.
- All entries remain the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion.
- These Terms and Conditions are governed by the laws of Western Australia.
